Terms of use

Last updated September 2026

Choose your region

These terms cover your use of Film By Us. By creating an account or using a capture or gallery link, you agree to them. They never take away consumer rights you have under your local law. Pick your region below for the governing law and consumer rights that apply to you.

1. Your account

You must be 18 or over to create an account. Keep your login details secure — you’re responsible for activity under your account. Tell us straight away if you think it’s been compromised.

2. What we provide

Film By Us collects wedding photos and videos from your guests through a shared link, stores them in a private gallery for your storage window, and — where your pass includes it — our editors turn them into a highlight film. Nothing is collected before your wedding is activated by a pass.

3. Your content and the licence you give us

You and your guests keep ownership of the photos and videos you upload. To run the service, you grant us a limited licence to host, store, process, transcode, edit, assemble and deliver that content back to you and the people you invite. We use it only to provide the service to you — not to advertise or for anything else without your permission.

You’re responsible for the content collected at your event and for making sure you have the right to share it with us for these purposes.

4. Guests and consent

Every guest agrees to be filmed and to their clips being used in your film before they can capture anything. Any guest can ask for their own clips to be removed at any time, and we’ll action it within about 24 hours — including from a film already delivered.

5. Music rights

You supply your own song. When you upload one, you confirm you hold the rights or a licence to use it, and you accept that Film By Us isn’t liable for music you supply. We don’t provide or license music. A commercial song isn’t automatically cleared just because it played at your wedding, and platforms like Instagram may mute it. If you don’t upload a song, your film is delivered silent.

6. Acceptable use

Don’t use the service to upload unlawful, infringing, or harmful content, to break the law, to disrupt or attack the platform, or to access events you weren’t invited to. We may suspend or remove content or access that breaches these terms.

7. Payments, passes and credits

Passes are priced in your local currency, with any applicable tax (such as GST) shown at checkout. A pass activates your wedding, grants your film credits, and sets your storage window (6, 12 or 18 months from your wedding day). Extra film credits can be purchased separately. Payments are handled securely by our payment provider.

8. Refunds

Your pass is fully refundable, no questions asked, until your event is used — see our Refund policy for exactly how that works. Nothing here limits any refund right you have under your local consumer law.

9. Availability and storage

We aim to keep the service available and your content safe for your storage window, and we’ll give reasonable notice before content is deleted at the end of it. We keep back-ups but can’t guarantee against all loss — please download anything you want to keep before your window ends.

10. Disclaimers and liability

The service is guest-powered — the quality of footage depends on what your guests capture, so we can’t guarantee any particular coverage or result. Except for guarantees that can’t be excluded under your local consumer law, the service is provided ‘as is’. To the extent the law allows, our liability for any claim connected to the service is limited to the amount you paid us for it. Region-specific consumer rights are set out below.

11. Termination

You can stop using the service at any time. We may suspend or end access if these terms are breached. Some things naturally survive termination — ownership, licences needed to deliver already-created films, and limits on liability.

12. Changes and contact

We may update these terms as the service evolves and will note the date at the top. The governing law and your consumer rights depend on your region — see the section below. Questions? Email hello@filmbyus.com.

13. Consumer rights & governing law (New Zealand)

If you’re a consumer in New Zealand, our service comes with guarantees that can’t be excluded under the Consumer Guarantees Act 1993, and we comply with the Fair Trading Act 1986. Nothing in these terms limits those rights.

If you acquire the service for the purposes of a business, you agree the Consumer Guarantees Act does not apply.

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.

This is written in plain English to be genuinely useful. It isn’t legal advice and doesn’t replace advice from a qualified lawyer in your country. Wherever your local consumer or privacy law gives you rights that can’t be waived, those rights prevail. Questions? Email hello@filmbyus.com.
